Terms of Service

1. The service
M3 Multimedia LLC DBA Agent on Record provides profile hosting for licensed insurance producers. You build your public profile through our setup flow, we host it at an agentonrecord.com address, and we provide related features according to your plan. Plans are Free, Verified, Professional, and Agency. By creating an account or submitting an application, you agree to these terms.
Agent on Record is a marketing and hosting platform. We are not an insurance company, agency, or producer, we do not sell insurance, and we are not affiliated with NIPR, NAIC, or any state insurance department.
2. Eligibility
The service is available only to individuals who hold an active insurance producer license in at least one U.S. state, and to agencies whose listed agents hold active licenses. We may decline or remove any profile if we cannot reasonably confirm a valid NPN in public producer records.
3. Payment terms
Paid plans are recurring monthly subscriptions with no setup fee, billed in advance through Stripe. Agency plans are billed as a flat monthly fee that includes the first five agent profiles, plus a monthly fee for each additional agent seat. Prices are posted on our pricing page and may change with at least 30 days' notice; changes never apply retroactively to fees already paid.
Free accounts. The free tier costs nothing, has no card on file, and is not a trial. A free profile is published and public in the same way a paid one is; the difference is which features are included. We may change what the free tier includes with notice.
Trials. Agency trials are started with a code we issue directly. A card is collected when the trial begins and nothing is charged until the trial ends, at which point the subscription starts automatically unless it is cancelled first. Codes work once and expire.
Complimentary accounts. We sometimes grant an account full access at no charge. These are discretionary, have no subscription behind them, and we may end the arrangement, in which case the account moves to the free tier rather than being closed.
Text credits. Text credit packs are one time purchases, not subscriptions. They are used only after the texts included with your plan run out, they do not roll over, and any unused credits expire at the end of the billing cycle in which they were bought. This is disclosed at checkout and must be acknowledged before purchase. Credit purchases are not refundable once texts have been sent against them.
If a subscription payment fails, we retry it. If recovery does not succeed, the account enters the process described in Termination below.
4. Refund policy
Monthly subscription fees are not prorated or refunded for partial months; cancel any time before your renewal date to avoid the next charge. There is no setup fee to refund.
5. Your responsibilities
- Provide accurate, current information, including your NPN, license states, license types, and carrier appointments
- Update us promptly when your license status, states, or appointments change
- Maintain any license, appointment, and continuing education requirements that apply to you; we do not monitor these for you
- Submit only testimonials given with the client's permission, and comply with your states' rules on testimonial use in insurance advertising
- Send review invitations and text messages only to people who have agreed to hear from you, as set out in Text messaging below
- Ensure your bio and profile content comply with applicable insurance advertising regulations in every state where you use the profile
You are solely responsible for the accuracy and regulatory compliance of the content on your profile. You agree to indemnify Agent on Record against claims arising from inaccurate information you supplied or from your sale of insurance products.
6. Prohibited uses
- Misrepresenting your identity, license status, appointments, or qualifications
- Creating a profile for another person without their authorization
- Publishing false, fabricated, or unauthorized testimonials
- Making rate guarantees, misleading claims, or statements that violate insurance advertising law
- Using the platform to collect Social Security numbers, health information, or other sensitive data from consumers
- Attempting to interfere with, scrape at scale, or reverse engineer the platform
7. Termination
You may cancel at any time, effective at the end of the current billing period. What happens next depends on the account type, and we would rather state it exactly than leave it vague:
- An individual agent who cancels moves to the free tier. Your profile stays online with the free feature set, and nothing is deleted.
- An agency whose payment stops keeps its pages online for a 30 day grace period. After 30 days the agency page and its agents' profiles are taken offline but retained. At 120 days the account is flagged for review; deletion at that stage is a decision we make case by case, not an automatic one.
- An agency that took a trial and never paid goes offline when the trial ends. If it is still unpaid 30 days later, the account and its data are permanently and automatically deleted, including the agency record, its agents' accounts and profiles, and their logins. This cannot be reversed. Export anything you want to keep before then.
We may suspend or terminate a profile immediately if the producer's license is revoked or surrendered, if the account violates these terms, if information on the profile is materially false, or if required by a regulator or court. Where practical, we will notify you and give you an opportunity to cure before termination.
8. Intellectual property
You retain ownership of the content you submit and grant us a license to host, display, format, and enhance it (including AI enhancement of your headshot) for the purpose of providing the service. The Agent on Record name, badge, design, and platform remain our property, and your right to display the badge ends when your subscription ends.
9. Text messaging
Messages we send to you. If you have an account, we may text you about it: a new review, a billing problem, a change to your profile. These are transactional messages, never marketing. You choose this at signup, you can turn it off in your dashboard, and replying STOP to any message opts you out. Message and data rates may apply. Our messages are sent over a registered 10DLC campaign.
Messages you send to your clients. Paid plans let you send a client your profile link or a review request by text. You supply the number and we transmit a pre written, platform branded message on your behalf. There is no free typing surface: the wording comes from our templates, and every message carries opt-out language.
You are responsible for consent. This is not shared responsibility. Before you send anyone a message through this platform:
- You must have that person's express written or verbal consent to contact them by text, obtained before the message is sent
- You may only message people who have already agreed to hear from you. Consent given to your agency, your carrier, a lead vendor, or another agent is not consent given to you.
- You may not use this platform for cold outreach of any kind, including to purchased or scraped lists
- You must honor opt-outs and stop contacting anyone who asks you to
The Telephone Consumer Protection Act (TCPA) and related state laws impose statutory damages, commonly cited at $500 to $1,500 per message, for texting someone without proper consent. Those penalties are assessed against the sender. Agent on Record is not responsible for messages sent without proper consent, and you agree to indemnify us against any claim arising from a message you sent or caused to be sent through the platform. We may suspend messaging on an account, or the account itself, if we believe messages are being sent without consent.
Each plan includes a monthly number of texts, and additional credits can be purchased. Both are described in Payment terms above. We may refuse or delay a send to protect the platform, the sending number's reputation, or carrier registration.
10. Client contact information you bring with you
The CRM tab lets you connect a GoHighLevel account or upload a spreadsheet so your client list sits beside your messaging tools. When you do that, we store the contact details you choose to bring: first and last name, phone number, email address, birthday, pipeline stage and tags. That is the entire list.
We do not store notes. We never request notes from a connected CRM, there is no field for them in our database, and if a spreadsheet you upload contains a notes column we drop it during import and tell you we did. The same goes for any other free text about a client. This is a deliberate limit on what we hold about people who never signed up with us.
What it is for. This information exists to power the tools you already use in your dashboard: seeing who your clients are, and texting one of them a resource, a birthday message, a check in or a review request. We do not use it to market to your clients, and we never sell it or share it with another agent.
You control it and you can take it with you. Disconnecting GoHighLevel deletes both the connection and the contacts we synced from it. You can export your whole list as a spreadsheet at any time, without asking us.
It follows your account. Contact information is subject to the same lifecycle as everything else on your account: if your account lapses it is locked along with your profile, if your account is archived it is archived with it, and when an account is deleted the contacts go with it. Section 7 covers that lifecycle in full.
You are responsible for having the right to hold and upload the client information you bring here, and for the consent rules in section 9 before you text any of them.
11. Reviews
Reviews are invitation only. A review can be submitted only through a link you send to a specific client. There is no public review form, and nobody can post a review of you unprompted.
Who owns a review. The client who writes it does. By submitting one and choosing to post it publicly, they grant us permission to display it on your profile. You do not own your reviews and cannot edit or delete them. You may publish one public reply to any review on your profile.
Removal. You may ask us to remove a review. We remove one only where there are grounds, for example where the reviewer was not a real client, where the content includes personal information, abuse, or an unrelated dispute, or where we are required to remove it. A low rating is never, by itself, grounds for removal. Reviews are displayed and ordered without regard to rating, and we do not offer any way to hide, filter, delay, or reorder reviews based on how positive they are. Asking us to do so is a violation of these terms.
Self entered testimonials, which you write yourself, are a separate feature from reviews and are labeled differently on your profile. The testimonial rules in Your responsibilities above apply to them.
12. Independent agents and agencies
Agent on Record (operated by M3 Multimedia LLC) is a hosting and verification platform providing licensed insurance agents and agencies with professional profile pages and related tools (the “Platform”). Each profile displayed on the Platform is created and controlled by the individual licensed agent or agency it belongs to (a “Platform User”). Agent on Record does not employ, supervise, or control the insurance business, sales practices, or client interactions of any Platform User.
No endorsement. “Verified” designations reflect that Agent on Record took commercially reasonable steps to confirm license information at the time a profile was created, using official producer-database documentation supplied by the agent. This is not an ongoing guarantee of licensure, a state certification, or an endorsement of any Platform User's products or conduct. Consumers should independently verify a current license at nipr.com or with the applicable state department of insurance before any transaction.
No liability for Platform User conduct. Agent on Record is not responsible for the accuracy of information a Platform User posts, any advice or representation a Platform User makes to a consumer, any transaction between a Platform User and a consumer, or any dispute arising from a Platform User's professional conduct. These matters are solely between the Platform User and the consumer.
Profile statistics. Paid plans show you counts of activity on your profile: views, contact form submissions, shares, and which sites referred visitors. These are aggregate counts. They do not identify individual visitors, and we do not provide you with the identity, contact details, or browsing history of anyone who views your profile without contacting you.
Platform User responsibility for consumer data. Each Platform User is independently responsible for their own collection, use, and protection of any consumer data gathered through their profile or tools, and for compliance with applicable data privacy and insurance regulations. Agent on Record acts solely as a hosting provider and is not a party to a Platform User's data practices. A Platform User's own linked privacy policy governs their data handling, not this policy, which covers only Agent on Record's own handling of account and billing data.
Your compliance is yours regardless of published pages. Agents and agencies are responsible for their own privacy practices, their own handling of leads and client contact information, and their own compliance with the laws and regulations that apply to them, including telemarketing and text-messaging consent rules, whether or not they publish privacy or terms pages on this platform. Publishing such pages here, or choosing not to, does not transfer any of that responsibility to Agent on Record.
Indemnification. Each Platform User agrees to indemnify Agent on Record and M3 Multimedia LLC from any claim arising from that Platform User's conduct or data practices.
13. Disclaimers and limitation of liability
The service is provided “as is.” We do not guarantee specific business results, search rankings, lead volume, or uninterrupted availability. To the maximum extent permitted by law, our total liability for any claim arising from the service is limited to the amounts you paid us in the 12 months before the claim arose, and we are not liable for indirect, incidental, or consequential damages.
14. Governing law
These terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Michigan, and both parties consent to their jurisdiction.
